Under the government Fast Track system, there are distinct differences to the standard RMA (Resource Management Act) process.
Procedure for the "normal" Resource Consent Application
- Apply to Auckland Council
- Limited notification = Council invites directly impacted parties to comment (e.g. neighbours, community group)
- Public notification = Anyone can comment
- Residents can respond if it is publically notified (or limited notification)
- Auckland Council makes the final decision
Procedure for the government Fast Track Application
This is a 2-step process overall.
Step 1 is an application for referral. Upon acceptance by the minister (Chris Bishop at the time of writing) the application will be permitted into step 2 of the actual fast track process, where the applicant lodges their substantive application.
- Apply to the EPA (Environmental Protection Authority)
- EPA appoints a Panel
- Panel can invite parties to comment – “limited notification”
- Council provides comment
- No input from residents, unless specifically invited (e.g. direct neighbours)
- Established community association may be invited to comment by the panel
- Panel makes final decision
